The estate planning process can get more complex the more comprehensive you want your plan to be. There are typically four documents that must be drafted through the process.
- A will: This document will describe your assets and personal property in as much detail as you desire. Often, a will is referred to as a document that details “who gets what and when.”
- Durable power of attorney: This could also be referred to as a financial power of attorney. This document allows you to name another individual to make financial decisions if you are unable to do so.
- Health care power of attorney: This could also be referred to as medical power of attorney. Here, you can name a proxy who can make medical decisions for you if you become medically unable to do so.
- Living will: Often used in conjunction with a health care power of attorney, a living will give instructions regarding the use of life-sustaining measures. This document clearly establishes your desires but does not name a proxy who can make decisions for you.
